一、食品安全的现状
近些年来,随着经济的高速发展,人们生活水平的不断提高,食品安全问题日渐成为人们关注的焦点,并发展成为一个世界性的问题:例如,1996年英国爆发的疯牛病、1997年香港禽流感、1998年东南亚猪脑炎、1999年比利时等国二恶英、2001年欧洲爆发口蹄疫、2003年发生在中国的非典型性肺炎(SARS),2008年9月,中国令人震惊的三鹿奶粉事件以及2009年全球性的甲型H1N1流感,这些食品安全事件使老百姓忧心忡忡,以至有的人产生了吃动物食品怕含激素,吃植物食品怕有毒素,吃饮料食品怕掺色素的恐惧心理。当然这种担惊受怕显属过虑,但却也从侧面反映了当今的食品安全方面存在着诸多问题,对此,笔者把这些问题主要概括如下:
1.一些蔬菜、水果中普遍残存化肥、农药等物质,使这些食品的安全状况令人十分担忧。在农业生产中,一些菜农、果农为了增收往往使用高毒甚至剧毒农药来喷洒蔬菜、水果,这直接导致蔬菜、水果的农药残留量超标,这样的蔬菜、水果被消费者食用后肯定会带来身体健康上的很大危

害。例如,在2009年曾经有相关的组织对北京市4家大型超市销售的樱桃、甜瓜、桃子、油桃、苹果5种水果进行抽查,结果一共检测出了17种农药,甚至有的农药是法律已经禁止使用的农药,可见某些农产品的质量安全问题是多么不容忽视。

二、食品安全问题产生的原因分析
1.由于相关部门对食品安全生产的操作监管不力,使得中国食品行业严重违规、违法生产销售不合格食品的现象屡禁不止。中国的食品监管一直采取分段管理为主、品种管理为辅的方法,在实际的操作过程中,各职能部门之间要么会出现争着监管、重复执法的现象,要么会出现争着不管、相互推诿扯皮的现象,这就给某些食品行业违法生产、销售不合格食品提供了可乘之机。
2.中国关于食品安全的法律体系中存在着诸多弊端和问题,为不少问题食品的产生提供了生存的空间。中国的食品安全法律条文规定的过于笼统,难以操作,并且这些法律

法规和标准体系严重滞后,现有的一些食品安全的标准水平规定偏低,许多指标远远低于国际标准,许多重要的标准至今还尚未制定出来,这就为那些不法厂商、企业违法生产超低标准、不合标准的食品提供了可乘之机。
3.消费者缺乏食品方面的常识,也可能会引起食物安全问题的产生。首先,消费者缺乏购买安全食品的常识。中国众多的消费者由于收入水平低下,没有足够的消费能力,加上缺乏相应的常识,所以在购买食品时安全意识淡漠,往往只图便宜,不顾及食品的质量、卫生问题。还有一些消费者在购买便宜食品、特价食品、无质量保证食品时,总是抱着侥幸心理,认为大家都在买,并且别人过去多年吃这些便宜食品也没吃出什么问题,现在再吃也不会有事,在消费者这种心理的支持下,就为问题食品的销售打开了门路。其次,很多消费者缺乏科学食用食物的常识,由此可能会引发一些疾病的产生,甚至导致食物中毒事件的发生。例如,在2009年810月,北京市丰台区已经连续发生4起扁豆中毒事件,发病人数达64人。据调查表明,中毒的主要原因是烹饪者未将扁豆煮熟、炒熟。其实像扁豆、豌豆、四季豆这三种蔬菜,其本身含有天然毒素,如果对它们加热不完全就被人们食用,则可能会引起人们的食物中毒。人们在炒菜时如果事先了解了这些基本常识,就可以避免这类食物中毒事情的发生。

三、解决食品安全问题的一些对策建议
1.政府应当切实履行好其监管职责,加强对食品质量的安全监管。加强食品质量的安全监管应当成为政府的头等大事,这就要求政府:要加强对食品的准入市场管制,提高食品的准入市场门槛,严防三无食品流入市场;要有效规范食品生产者的生产、经营行为,坚决取缔无证生产、无证加工食品的行为;要整合食品安全监督、检测资源,更新检测装备,加强对食品质量安全的监测,对食品从生产、加工、管理、贮运、包装到销售的全过程都要进行严格的监控;要全面严厉打击生产、销售假劣食品和不合格食品的违法犯罪活动;要规范食品采购渠道,从源头上控制不安全、不合格食品流入市场。
2.完善中国的食品安全法律体系。首先,应当建立科学、完善的食品安全标准系统。对此,笔者认为,我们可以借鉴世界上一些发达国家的先进经验,进一步细化和规范食品安全生产领域内的法律制度,制定出切实可行的食品安全方面的具体标准。同时,要提高中国的食品安全标准,使中国的食品安全标准与国际标准相接轨。其次,要加强法律法规对危害食品安全行为的惩罚力度。中国的《食品卫生法》规定,对违法企业只能是责令停止生产经营、没收违法所得,或者处以额度不高的罚款(一般都是在3万元以下),只有情节严重才会被吊销卫生许可证。可见,中国法律中对食品犯

罪的处罚与世界上其他国家相比都要轻得多。这样轻的处罚,使生产经营者的违法成本比守法成本还要低,所以这对于打击制造低劣、伪冒食品者几乎起不到威慑作用。
笔者认为,我们可以借鉴国外的巨额赔偿制度,对生产和销售质量不合格、不安全食品的厂商处以高额罚款,情节严重的还应当加重追究其刑事责任,以达到足以震慑其危害食品安全行为的作用。
3.向广大消费者宣传、普及食品安全方面的知识。通过加大对消费者进行食品安全方面的宣传教育,使消费者了解更多的食品安全常识和健康饮食知识,使消费者增强食品安全意识,提高辨别问题食品的能力,自觉抵制问题食品,把食用不合格食品杜绝于消费者的消费观念之外。对此,我们可以通过网络、电视、报纸、杂志、广播等工具,定期组织健康饮食宣传活动,有计划地报道食品安全知识,并且要及时曝光生产、销售假冒伪劣食品的一些不法厂商及其商品,披露最近发生的食品安全事件,以保障消费者的消费知情权
